HRSDC/SC Labour Market Opinion Applications

The LMO application is made to HRSDC/SC who may confirm the job offer.  In reaching a decision, it will consider whether the job offer is genuine, if the wages and working conditions offered are comparable to those payable to Canadians working in the occupation, whether the employer made reasonable efforts to hire or train Canadians for the job and if the foreign worker is filling a labour shortage. HRSDC/SC will also consider if the employment of the foreign worker will directly create new job opportunities or help retain jobs for Canadians and if the foreign worker will transfer new skills and knowledge to Canadians.

 In reaching a decision, HRSDC/SC will use the Canadian National Occupational Classification (NOC) system to identify the occupation that the foreign worker is to be engaged in and will review the labour market information to determine the prevailing wages and working conditions.The National Occupational Classification (NOC) will also determine the minimum advertising efforts required of you.

If HRSDC/SC is satisfied that your hiring of the foreign worker will have a positive or neutral effect on the Canadian labour market and that it will not affect current or foreseeable labour disputes at your workplace, nor the employment of any Canadian worker involved in such disputes, it will confirm your hiring of the foreign worker.

The LMO confirmation letter is not a work permit. The foreign worker must still apply to Citizenship and Immigration Canada (CIC) for a work permit and must satisfy the criteria for this.
